By accessing or using Horizon Checkout (the "Service"), operated by Horizon Tech ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

You must be at least 18 years of age to use the Service. By using the Service, you represent that you meet this age requirement.

Horizon Checkout is a productivity tool that helps users monitor product availability and streamline purchasing workflows. The Service includes a desktop application, web dashboard, and associated infrastructure.

The Service acts on your behalf using configuration you provide. We do not guarantee successful outcomes, product availability, or specific results from using the Service.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

• Provide accurate and complete registration information
• Notify us immediately of any unauthorized use of your account
• Not share, transfer, or sell your account to another person
• Not create multiple accounts to circumvent restrictions or bans

The Service interacts with third-party websites and platforms. You are solely responsible for:

• Complying with the terms of service, acceptable use policies, and any other rules or guidelines of all third-party services you access through the Service
• Understanding and accepting the risks associated with using automation tools on third-party platforms
• Any consequences that may arise from your use of third-party services, including but not limited to account restrictions, order modifications, or access limitations

We do not endorse or encourage any violation of third-party terms of service. Horizon Tech is not liable for any actions taken by third parties in response to your use of the Service.

You agree not to use the Service to:

• Engage in any activity that is illegal or violates applicable laws or regulations
• Resell or commercially redistribute the Service without authorization
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Interfere with or disrupt the integrity or performance of the Service or its infrastructure
• Engage in abusive or excessive automated activity that degrades third-party services
• Circumvent or attempt to circumvent any access restrictions, rate limits, or security measures of the Service
• Use the Service for any purpose that could harm, defraud, or deceive other users or third parties

The Service, including its code, design, logos, and documentation, is the property of Horizon Tech and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these terms.

You may not:

• Copy, modify, or distribute the software
• Create derivative works based on the Service
• Remove or alter any proprietary notices or labels
• Use our trademarks or branding without written permission

Access to the Service may require a paid subscription. By subscribing, you agree to pay all applicable fees. Subscription terms, pricing, and billing cycles will be clearly presented before purchase.

• Fees are non-refundable except as required by law or stated in our refund policy
• We reserve the right to change pricing with reasonable notice
• Failure to pay may result in suspension or termination of access

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to our data practices as described in the Privacy Policy.

You are solely responsible for the security of your local vault password and recovery key. We cannot recover locally encrypted data if you lose access to these credentials.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, error-free, or secure
• Any particular outcome will result from using the Service
• The Service will be compatible with all third-party platforms at all times
• Third-party services, availability, or processes will remain consistent or accessible

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HORIZON TECH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

This includes, without limitation, any damages resulting from interactions with third-party services, data loss, or service interruptions. Our total liability for any claim shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless Horizon Tech, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising out of or related to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights, including third-party terms of service
• Any content or data you provide through the Service

We reserve the right to suspend or terminate your account at any time, with or without cause, including for violation of these Terms. Upon termination:

• Your right to use the Service immediately ceases
• Your locally stored data remains on your device under your control
• We may delete your server-side account data after a reasonable period

You may terminate your account at any time by contacting us or through the account settings.

We may revise these Terms at any time. Material changes will be communicated through the application or by email with reasonable advance notice. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of competent jurisdiction.
